This User Agreement ("Agreement") is a legal contract between you and InfluencerChic ("we", "our", or "us") governing your use of the creator/influencer marketing platform InfluencerChic (the "Platform"). By accessing or using the Platform, you agree to be bound by the terms and conditions of this Agreement.
1. Acceptance of Terms
By accessing or using the Platform, you agree to comply with this Agreement and any additional terms and policies referenced herein. If you do not agree to abide by these terms, you may not access or use the Platform.
2. Eligibility
You must be at least 18 years old to use the Platform. By accessing or using the Platform, you represent and warrant that you are of legal age to enter into this Agreement and meet all other eligibility requirements.
3. User Accounts
You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
4. User Content
You retain ownership of any content you submit, post, or display on the Platform ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation of the Platform.
5. Prohibited Conduct
You agree not to engage in any conduct that violates this Agreement or any applicable laws or regulations. Prohibited conduct includes, but is not limited to:
Using the Platform for any unlawful purpose or in violation of any third-party rights
Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity
Uploading, posting, or transmitting any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable
Interfering with or disrupting the operation of the Platform or any servers or networks connected to the Platform
6. Intellectual Property Rights
All intellectual property rights in the Platform and its content are owned by us or our licensors. You may not copy, modify, distribute, transmit, display, perform, or create derivative works of the Platform or any content without our prior written consent.
7. Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify and hold us harmless from and against any claims, damages, liabilities, costs, and expenses arising out of or in connection with your use of the Platform or any violation of this Agreement.
9. Termination
We may terminate or suspend your access to the Platform at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms of this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the relevant jurisdiction, without regard to its conflict of law provisions.
11. Entire Agreement
This Agreement constitutes the entire agreement between you and us regarding your use of the Platform and supersedes all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
